§ 210.071. Fireworks Display.

A.General. The display of fireworks, including displays for audience, and pyrotechnic special effects for the purpose of motion pictures, television, theatrical and group entertainment shall comply with all provisions of the adopted Fire Code for the City of Lake Tapawingo, NFPA 1123 or 1126, the State of Missouri, the Central Jackson County Fire District and all further requirements contained within this Section.B.Permit Application. All fireworks displays within the City of Lake Tapawingo shall be subject to approval of the Mayor and Board of Aldermen or their appointed designee and shall require a City issued permit. A twenty-five dollar ($25.00) non-refundable fee shall be collected upon application for a fireworks display permit. Prior to issuing a City permit for the purpose of fireworks display, the applicant shall produce the following items for review:1.Name and license of Missouri State licensed pyrotechnic display operator who will supervise the display on site;2.Name and photo identification of all on-site workers assisting with the display;3.Proof of insurance coverage insuring the applicant with liability insurance with an occurrence limit of not less than one million dollars ($1,000,000.00);4.An approved fireworks display permit from the Central Jackson County Fire District.C.Site Safety Provisions. All displays shall be handled by an approved competent operator and the fireworks shall be arranged, located, discharged and fired in manner that will not pose a hazard to any individual, group or property. In addition, the following requirements shall apply:1.Spectators, spectator parking areas, buildings, dwellings or other structures shall not be allowed within the display site, except as provided for in the Fire Code or approved by the Central Jackson County Fire District;2.Diagrams shall be submitted to the City outlining the display site and fallout areas;3.No one under the age of eighteen (18) shall be allowed within the display site or immediate area;4.Motorized vehicles shall not be operated within the display site;5.Consumption of alcohol by display operators, employees or assistants is expressly forbidden;6.If any road, lane, alley, public way, access point, public easement, public facility or means of emergency ingress/egress/access shall be blocked for the purpose of fireworks display or for protection and security of the fireworks display site, blockage of the street and security of the display site shall be handled by the Lake Tapawingo Police.7.If the nature of need for securing the display site, blocking streets or enforcement of the provisions of this Section shall require the Chief of Police to provide Police service above and beyond normal staffing levels, the cost of extra officers shall be borne by the display operator/permit applicant and shall be paid prior to issuance of any permit by the City.8.If at any time the Chief of Police for the City of Lake Tapawingo or his designee shall determine in their opinion that a hazardous condition exists or that provisions of this Section are being violated, they may discontinue the display of fireworks immediately until such time as the situation is, in their opinion, remedied.D.Penalty—Severability—Effective Date. This Section shall be in full force and effect immediately upon its passage and approval, The provisions of this Section are severable, as provided in Section 1.140, RSMo. Those provisions of this Section which establish an offense are subject to the general penalty provisions provided by law. Where discrepancy exists between this Section, the adopted Fire Code for the City of Lake Tapawingo, NFPA and the State Statutes for Missouri, the more restrictive rule shall apply.
