§ 210.070. Fireworks, Discharging.

  • A. 
    No explosive fireworks will be discharged within the City of Lake Tapawingo, Missouri, except on July 1, July 2, July 3 and July 4.
    B. 
    Fireworks will be permitted only between the hours of 10:00 A.M. and 10:00 P.M. on said days, except on July 4 they will be permitted from 8:00 A.M. until 12:00 midnight.
    C. 
    Specifically prohibited at any time shall be the use of any fireworks or discharge of same, known as bottle rockets or any similar fireworks known by another name.
    D. 
    It shall be unlawful for any person to throw, use, explode, discharge, detonate, aim, point or shoot any fireworks on all streets, parks, boat lots and the lake owned by the Lake Tapawingo Country Club.
    E. 
    Only consumer grade, Class C fireworks will be permitted to be discharged by individuals within the city limits on the dates and at the times listed in Subsections (A) and (B) above.
    F. 
    Any person who is the owner in possession, a tenant or subtenant, or has temporary control of any residence or premises shall be responsible for any violation of this section that occurs on said property where the person knew or reasonably should have known that fireworks were being discharged in such a manner.
    G. 
    All types and sizes of aerial fireworks that have a cylinder or cartridge must be fully and completely consumed (burned up) before landing.
    H. 
    It shall be unlawful to throw, use, explode, discharge, detonate, aim, point or shoot any type of fireworks from any watercraft.
    I. 
    No person shall throw, use, explode, discharge, detonate, aim, point or shoot fireworks in such a manner that after it is ignited, will propel the fireworks, or any part thereof, such that it lands on residential property not owned or in possession of the person from whose property the fireworks were discharged.
    J. 
    Commercial displays by or on behalf of the Lake Tapawingo Country Club are exempt from Subsection (E).
    K. 
    The Chief of Police, at his sole discretion, can grant written permission to individuals to use, explode, discharge or detonate specific fireworks on or near the lake for the sole purpose of controlling and deterring wildlife (ducks and geese).
    L. 
    Violators will be deemed guilty of a misdemeanor, to be fined not less than one hundred dollars ($100.00) nor more than two hundred fifty dollars ($250.00), for each offense. Restitution of all damages caused either to personal property of any person or persons or their guests, any property belonging to the City of Lake Tapawingo or the Lake Tapawingo Development Company or the Lake Tapawingo Country Club or the property of any guests shall be made in full by the violator of this Section.
