§ 100.100. Guidelines Defining Nepotism.

    Any elected or appointed officer, employee or member of any committee, authority, board or commission of the City of Lake Tapawingo, Missouri, shall not hire any relative. All hiring decisions shall comply with:
    1. 
    Neither the Mayor, the Council, the City Clerk/Administrator nor any Board Member, employee or agency of the City Government may appoint or elect any person related to the Mayor, to any other Council member, to the City Clerk/Administrator or to himself/herself or, in the case of a plural authority, to one of its members by affinity or consanguinity within the fourth degree, to any office or position in the City Government; but this shall not prohibit any Board member or employee already in the service of the City from continuing therein so long as the employee is not in direct line of report to his/her relative.
    2. 
    Any such appointment or election shall be null and void. The Mayor, any Council member, Board member or employee who appoints a person so related to him/her or who, as a member of a plural authority, knowingly votes to appoint or elect a person so related to him/her shall thereby forfeit his/her office or position.
    3. 
    It is the explicit policy of the City of Lake Tapawingo to prohibit any City Official or employee from participation in the hiring of a relative.
    4. 
    It is the explicit policy of the City of Lake Tapawingo to prohibit any City Official or employee from working under the supervision of a relative.
    5. 
    It is the explicit policy of the City of Lake Tapawingo to prohibit any City Official or employee from being promoted, transferred or reinstated in or to any position and shift where the employee will supervise directly or be supervised directly by any relative.
    6. 
    Upon marriage, where a situation of nepotism is created under Subsection (5) above, the employee with the least seniority with the City of Lake Tapawingo will be terminated unless other solutions are made. For purposes of this Subsection (3) only, a "relative" means any person related by affinity or consanguinity within the second degree. Other methods for resolution may include the employee with the most seniority submits his/her resignation; or one (1) of the effected employees is qualified and willing to accept placement in another department or area and such placement would eliminate the violation of Subsection (3) above. A vacancy must exist and the employee successfully competes for the vacant position within the limits of the City's requirements for said position.
